In the journal European Human Rights Law Review, 2025, Issue 4, our research associates Isabel Kienzle and Melina Riemer discuss the judgments on pushbacks from Greece delivered by the European Court of Human Rights at the beginning of 2025.
In A.R.E. v. Greece and G.R.J. v. Greece, the ECtHR for the first time expressly acknowledged the long-standing systematic practice of pushbacks at Greece’s land and sea borders. Both judgments are shaped significantly by questions of evidence. The article builds on the analysis presented in an previous blog post and offers a critical examination of the ECtHR’s fact-finding.
